The plaintiffs below, Leon Holloway and his wife, Helen Holloway, brought this action against the Skelly Oil Company to recover damages for the destruction of their house and furnishings by fire alleged to have been caused by negligence on the part of the defendant company. This case was tried before a district judge sitting without a jury and resulted in a judgment in favor of plaintiffs from which this appeal was taken.
